In an order filed Wednesday February 9, 2011, US Magistrate Judge Barry M. Kurren delayed the beginning of the trial for accused human trafficker Mordechai Orian and other defendants for one year due to the complexity of the case.

While defendants are usually guaranteed a speedy trial by the Speedy Trial Act, which is intended both to safeguard the rights of defendants and also protect the public interest, a delay is possible if necessary to serve the “ends of justice.”

…on the grounds that the ends of justice served by granting this continuance outweigh the best interest of the public and defendants in a speedy trial. This case as previously been declared complex on October 4, 2010.

The Court bases its finding on grounds that on January 20, 2011, the defendants were arraigned on a Superseding Indictment which added additional charges and two additional defendants, Bruce Schwartz and Joseph Knoller. Additional discovery will be forthcoming. The government has represented that there are numerous witnesses in the United States, Thailand, and Israel. There is approximately 85,000 pages of pretrial discovery. All of the defendants have agreed to the new trial date.

WHEREFORE, the Court finds that given the nature of the case and the number of defendants, the delay from February 23, 2011, to February 7, 2012, is reasonable.Accordingly, jury selection and trial are set for February 7, 2012 at 9:00 a.m.
