Judge Susan Oki Mollway today affirmed the order by Magistrate Judge Barry M. Kurren to release accused human trafficking defendant Mordechai Orian to the custody of the Chabad rabbi, Rabbi Itchel Krasnjansky, in Honolulu.

Orian will be allowed to leave their facility for medical reasons, to visit his attorneys, and as allowed by Pretrial Services, to conduct business.

Where is Chabad Hawaii? From their web page:

Our school and offices are at the Ala Moana Hotel (410 Atkinson Drive in Waikiki) in the Kona Tower, 2nd Floor, Suite 2E1.  The shul is located in the hotel lobby, next to the Kona Tower elevators.

So Orian will be in the Ala Moana Hotel.

Judge Mollway turned down the Department of Justice request that Orian be forbidden to work on labor contracts, saying she will leave those things to Pretrial Services. She said that she has no trouble releasing him because these cases do not carry a presumption of pretrial detention as a requirement.

The appeal was based on the DOJ position that there was nothing new that has come up that was not previously considered in previous hearings. Judge Mollway disagreed, saying that release to Chabad was new to her, and that Judge Kurren was correct in considering and accepting that proposal. The DOJ also held that there was not a sufficient relationship between the rabbi and Orian, but that was not persuasive.

Orian will be released from the Federal Detention Center as soon as the electronic monitoring and other facilities are in place for him at Chabad.

Judge Mollway also affirmed Judge Kurren’s decision as to release of Pranee Tubchumpol to the custody of her boyfriend in Los Angeles. She has been living since 2008 with her 70-year-old ex-husband, and her relationship with her boyfriend has been only for one year. Her attorney pointed out that he has put up his property as bond for her release and that he flew to Honolulu for Friday’s hearing to present the papers. She will be released to her boyfriend as soon as the paperwork is completed.

The DOJ considers both defendants to be flight risks. Orian has a deportation order against him and could be detained by ICE (Immigration and Customs Enforcement).

DOJ attorney Susan French and Mordechai Orian’s attorney Mark J. Werksman appeared by telephone. Local counsel was also present in the courtroom.
