With the additional 12-count indictment just handed down by a grand jury, the Aloun Farms Sou brothers are reported to face up to 20 years in prison if convicted. While they are, of course, innocent until convicted, there is sufficient documentation based on their earlier guilty plea agreement to suggest that some or all of those charges will stick.

Yet there has not been condemnation of human trafficking in the media, by politicians, or by agricultural officials.

Quite the opposite—the brothers were supported even when they had pleaded guilty. That sends an unmistakable message that Hawaii is not only soft on human trafficking, but condones it.

Hawaii’s civil rights problems are often left for the feds to correct us. Whether it is cheating special ed students of their education, overcrowding at the State Hospital, or our prison situation, we fail to do the right thing until a federal judge sets us straight. In the case of Aloun Farms, support for the farm has taken precedence over support for the workers’ rights.

Let’s start with legislation. Hawaii is listed in the Polaris Project “Dirty Dozen” list of states that have inadequate laws applying to human trafficking. And mysteriously, we failed to correct this when we had a chance.

The Hawaii State Senate removed labor trafficking from SB2045, a bill introduced in this year’s legislative session, leaving only sex trafficking. The bill had problems, and was deservedly vetoed by Governor Lingle. In any case, its defeat meant that there was no change in Hawaii’s laws affecting involuntary servitude.   [Disappeared News, 9/15/2010]

That bill, or a better one, should be resurrected, cleaned up, and introduced in this coming session.

Next, our leaders might switch their sympathy from farm owners who profit from human trafficking to the workers who have been cheated and have suffered so much.

The Hawaii Farm Bureau allowed Aloun Farms to remove their large “Aloun Farms” banner at the Saturday KCC Farmers Market after some shoppers complained at the nearby Farm Bureau tent. The sign came down when the guilty plea was in force.

I wrote to the Farm Bureau on September 17 asking why Aloun Farms was being granted a special privilege, since they request all vendors to include a sign “identifying your farm/company prominently displayed.”

The letter has not been answered. Each week Aloun Farms continues to do business from an anonymous tent. You can find them next to Nalo Farms near the entrance to the market.

Hawaii’s government and community leaders have also come out for the alleged traffickers rather than the trafficked workers. When the Sou brothers were awaiting sentencing (and so guilty, rather than innocent),

Former Democratic Gov. Ben Cayetano called the Sou family's immigration from Laos and creation of a farm a "remarkable success story." Former Democratic Gov. John Waihee commended the Sous' skill in transforming sugar fields into diversified farming.

Others who offered support to the brothers include the former head of the state Land Board, the state Department of Agriculture, the Hawaii Foodbank, competing farms, two banks who are owed money from the farms and former Aloun employees.  [Fox News, Some Say Hawaii Farm Too Big To Fail After Farmers Convicted of Human Trafficking, 9/4/2010]

Cayetano was celebrating the brothers’ success even though that success was built, according to their guilty plea, on the misery and impoverishment of their workers. It’s important to note that at the time these statements were made, it was not “alleged” trafficking but admitted trafficking. The brothers were awaiting sentencing on charges to which they had plead guilty. They faced prison time. Cayetano and others were asking for leniency.

Prosecutors accuse them of manipulating the Thai workers by promising at least a year's employment at pay of $9.42 an hour, but instead delivering only a few months of work for little pay.

If the workers complained, Mike Sou threatened to send them home without any way to repay recruitment fees exceeding $30,000 that they borrowed from Thai money lenders to pay for their jobs, federal authorities claim.

The workers were trapped on the farm, forced to choose between long hours with low wages and an unpromising future in Thailand, said former farm worker Somporn Khanja, who arrived at the farm in 2004.

Hawaii needs to stop supporting human trafficking and not side with traffickers. Hawaii should fix its laws and get off the wrong lists.The Farm Bureau should let Aloun Farms face the music (should they be convicted) instead of providing exceptional protection for them and their farming practices.

It’s the right thing to do.
