Disappearing Maui dam now to come back

Walukuli Dam on Maui was supposed to disappear but now it’s coming back.
I saw the meeting notice at the top right corner of today’s Star-Advertiser “Hearings on dam safety” and confused it with another meeting the next day, with one item about dams on its agenda. It’s a meeting of the Board of Land and Natural Resources to be held Thursday (10/14/2010) at 9 a.m.
But I don’t know what this is really about. Specifically, I was wondering about item 17:
17. Authorize the Chairperson of the Department of Land and Natural Resources to Negotiate the Terms and Conditions, and Sign a Memorandum of Understanding between the Department, Kahoma Land LLC and Pioneer Mill Company LLC /Kaanapali Land Management Corporation, for the remediation of Wahikuli Dam and Reservoir (HI ID #0055), Lahaina, Maui County, located at TMK Nos. (2) 4-5-21:002 and 022.
Does it need an EIS? Why is this being delegated to the chairperson to negotiate?
The project originally had $14,530,000 in funding, no small change, but now there is a MOU with different terms because the dam structure is to be rebuilt.
